In order to commence providing assistance to you and to act on your behalf, we will require payment into our Trust Account, to be held on account of our future professional fees and disbursements.
If we do not receive a payment into our Trust Account by the nominated date on our initial letter, we may not undertake any works on your behalf, and if any works have been completed in the meantime, we will invoice you accordingly.
Should we receive money into our Trust Account on your behalf, you authorise us to draw on that money to pay any amount due to us in accordance with the provisions of the Legal Profession Uniform Law Application Act 2014 or ‘Uniform Law’, and the Legal Profession Uniform Rules.
Provided that you do not object, or provide another means of payment, we will draw upon your funds held in our Trust Account on the seventh working day from the date of issue of your Tax Invoice.
You must continue to make further deposits into our Trust Account as agreed, in order to keep a positive balance in the Trust Account. Unless determined by us to be extraordinarily urgent, we will not be prepared to undertake further works on your matter if there are no moneys held in our Trust Account on your behalf.
You have a right to cease works at any time in writing, and any money held in the Trust Account on your behalf, excluding any money owed to us by you, will be returned to you.
We will issue receipts for any payments into the Trust Account and when any money from the Trust Account is transferred/used to pay your Tax Invoice. A Trust Account Statement will also be forwarded to you upon request and after the completion of your matter.
Please be reassured the money held in our Trust Account on your behalf is not withdrawn for our personal use, nor is invested to gain interest. We are audited by an independent Trust Account Auditor in accordance with the requirements of the Uniform Law.
The money that you deposit into the Trust Account is yours and at the conclusion of your matter, you will be entitled to a refund of any money remaining in the Trust Account on your behalf.
